Tổn thương danh dự được hiểu là hành vi gây ảnh hưởng đến uy tín, danh dự, và nhân phẩm của một cá nhân. Pháp luật Việt Nam bảo vệ danh dự, nhân phẩm của cá nhân, được thể hiện trong Bộ luật Dân sự.

Xúc phạm danh dự, nhân phẩm là gì?

Hiện nay, pháp luật chưa có định nghĩa cụ thể về "xúc phạm danh dự, nhân phẩm". Tuy nhiên, có thể hiểu rằng xúc phạm danh dự, nhân phẩm là hành vi sử dụng lời nói thô bỉ, tục tĩu để nhục mạ, nhằm hạ uy tín và gây thiệt hại đến danh dự, nhân phẩm của người khác.

Các hình thức tổn thương danh dự

Tổn thương danh dự có thể thể hiện dưới nhiều hình thức khác nhau, bao gồm:

Sử dụng lời nói, cử chỉ thô bạo, khiêu khích, trêu ghẹo, hoặc lăng mạ người khác.

Đưa thông tin sai sự thật, xuyên tạc, vu khống, hoặc xúc phạm uy tín của người khác.

Xử lý hành vi tổn thương danh dự

1. Xử phạt hành chính:

Phạt cảnh cáo hoặc phạt tiền từ 100.000 đồng đến 300.000 đồng đối với hành vi có cử chỉ, lời nói thô bạo, khiêu khích, trêu ghẹo, xúc phạm danh dự, nhân phẩm của người khác.

Phạt tiền từ 2.000.000 đồng đến 3.000.000 đồng đối với hành vi khiêu khích, trêu ghẹo, xúc phạm, lăng mạ, bôi nhọ danh dự, nhân phẩm của người khác.

Phạt tiền từ 20.000.000 đồng đến 30.000.000 đồng đối với hành vi đưa thông tin sai sự thật, xuyên tạc, vu khống, xúc phạm uy tín, danh dự và nhân phẩm của cá nhân.

2. Trách nhiệm hình sự:

Người nào xúc phạm nghiêm trọng nhân phẩm, danh dự của người khác có thể bị truy cứu trách nhiệm hình sự về tội "Làm nhục người khác".

Hình phạt có thể là cảnh cáo, phạt tiền từ 10.000.000 đồng đến 30.000.000 đồng hoặc phạt cải tạo không giam giữ đến 03 năm.

Trong một số trường hợp, người phạm tội có thể bị phạt tù từ 03 tháng đến 05 năm, tùy thuộc vào mức độ nghiêm trọng của hành vi.

3. Bồi thường thiệt hại:

Người có hành vi xâm phạm danh dự, nhân phẩm của người khác phải bồi thường thiệt hại.

Thiệt hại bao gồm chi phí hợp lý để hạn chế, khắc phục thiệt hại, thu nhập thực tế bị mất hoặc bị giảm sút và một khoản tiền khác để bù đắp tổn thất về tinh thần.

Mức bồi thường bù đắp tổn thất về tinh thần do các bên thỏa thuận, nếu không thỏa thuận được thì mức tối đa không quá mười lần mức lương cơ sở.

Ví dụ:

Anh A đăng tải thông tin sai sự thật trên mạng xã hội, vu khống chị B có hành vi vi phạm pháp luật. Hành vi này không chỉ gây ảnh hưởng đến danh dự, uy tín của chị B mà còn có thể bị xử lý hành chính hoặc hình sự tùy theo mức độ nghiêm trọng. Anh A có thể bị buộc phải xin lỗi công khai và bồi thường thiệt hại cho chị B.
